JUDGE & PROSECUTOR COUPLE SENTENCED TO 8 YEARS IN PRISON ON 18 MAY 2018

Judge Hatice Özcan and her husband prosecutor Cahit Özcan were respectively sentenced to 7 years 6 months and 8 years 1 month in prison over the pretext of terrorism charges on 18 May 2018. Moreover, court ruled continuation of detention for Cahit Özcan.

They were accused of having 1 $, meeting through alleged Gulenists for marriage which were considered as crimes by current assize courts.

JOINT LETTER | Pressure mounts on Prime Minister to raise barristers’ urgent concerns with Turkey : Bar Human Rights and The Bar Council of England and Wales

The Bar Council of England and Wales and the Bar Human Rights Committee (BHRC) have written jointly to Prime Minister Theresa May, urging her to voice concerns over Turkey’s ongoing and large-scale prosecution of judges, lawyers, journalists and human rights defenders with the Turkish President when the two meet on Tuesday.

The letter, which has also been copied to the Lord Chancellor and the Foreign Secretary, is the second such letter that the Bar Council and BHRC have written to the UK Prime Minister on the injustices in Turkey. The legal bodies refer to further information that, since the failed coup in 2016, 2431 (out of 4560 dismissed) judges and prosecutors, 580 lawyers, and 319 journalists and media workers have been arrested; an estimated 1000 judges and prosecutors, 400 lawyers and 180 journalists and media workers are still detained; and more than 5,966 judges, prosecutors and lawyers are facing prosecution.

Andrew Walker QC, Chair of the Bar Council, said:

“The seriousness of what legal professionals and human rights defenders have been – and continue to be – subjected to in Turkey cannot be overstated. The impact reaches internationally. This is a significant threat not only to those individuals affected, but also to the fundamental principles of the rule of law, without which a truly fair and democratic society cannot exist, and which authorities are duty-bound to protect.

“We have previously highlighted this turbulent state of affairs, both in the media and directly to the Prime Minister, and it is a reflection of the urgency of the situation that we do so again, in the hope that an end can finally be brought to these injustices. We cannot stand by in the face of the wholly unjust suppression of the fundamental rights of our fellow lawyers, and we strongly urge the Prime Minister to express the serious and continuing concerns of the international community to President Erdoğan when they meet.”

Kirsty Brimelow QC, Chair of BHRC, commented:

“Recently, I carried out interviews with judges and prosecutors who have fled different parts of Turkey. The evidence gathered included attempts to compromise their independence. Upon refusal to comply, they were dismissed, suffered raids upon their houses and had their assets frozen. They escaped before the danger of being arbitrarily detained and subjected to ill-treatment and torture was realised. This danger is on the increase in Turkey with judges now dying in prison.

“The judges and prosecutors I met are representative of the thousands of lawyers, judges, journalists, teachers and human rights defenders purged from their family lives in Turkey. The rule of law is being misused as a weapon to undermine the law.

“We as lawyers support the fundamental right of lawyers, judges and journalists to act without State interference and to act for those, judge those and report upon those who may be subject to government disapproval.

“If the meaning of democracy is to retain any credibility, the Prime Minister is under a duty to raise objection to Turkey’s continued crackdown on its people and to seek its compliance with international law.”

OMER Faruk Gergerlioglu: ‘Enough is enough, set free the prosecutor father of disabled children’

Seyfullah Çakmak, former prosecutor of province Kocaeli and father of two 98 percent disabled children has been held under arrest since July 17.

Despite Çakmak, detained as a part of FETO investigation, has requested for pending trial many times due to his disabled children in need of his care, his indictment was prepared 9 months later and the court ruled for the continuation of his arrest.

Ömer Faruk Gergerlioglu brought the issue as to the cutting of their disability pension into agenda, being in hot pursuit of the issue.

However, after the issue had become the public knowledge due to their applications were rejected for many times, the disability pension of the severely disabled children was repensioned.

Gergerlioglu wrote in his several columns that the disabled children had gone under the wrecking ball due to their fathers’ stiuation and added that Çakmak requested to be transferred from Silivri Prison to his home town Kocaeli T Type prison.

Çakmak will appear before the court tomorrow for the first time.

Attracting attentions for the case of Çakmak from his social media account one more time, Gergerlioglu said:” Seyfullah Çakmak, former prosecutor and father of two 98 percent disabled children has been held under pre-trial detention for 23 months on the baseless grounds. His children are all disabled, their care is very difficult, their mother depleted and has no staying power. Tomorrow, his first hearing will be held. I have written so many times up to now…ENOUGH IS ENOUGH SET FREE HIM…!”

ÖLEN SAVCI HSYK TARAFINDAN AÇIĞA ALINDI VE HAKKINDA GÖZALTI KARARI VERİLDİ

HSYK’nın 15 Temmuz 2016 gecesi açığa aldığı ve akabinde de hakkında gözaltı kararı çıkarılan Cumhuriyet savcısı Ahmet Biçer’in, 15 Temmuz’dan aylar önce vefat ettiği anlaşıldı.

Bandırma Cumhuriyet savcısı Ahmet Biçer, 36 yaşında, 23 Mayıs 2016 tarihinde kalp krizi geçirerek hayatını kaybetti.

Sözcü Gazetesi yazarı Saygı Öztürk 20 Temmuz 2016 tarihli köşe yazısında, “mezarda görevden alındı” ara başlığıyla, açığa alınma tarihinden aylar önce vefat etmiş olmasına rağmen HSYK tarafından açığa alınan Biçer ile hakim ve savcıların açığa alınmalarına yönelik bazı iddiaları yazdı:

“Hakim ve Savcılar Yüksek Kurulu (HSYK) cemaatçi oldukları gerekçesiyle 2 bin 745 hakim ve savcıyı açığa aldı. Bunlardan biri de 37 yaşındaki Bandırma Cumhuriyet Savcısı Ahmet Biçer’di. Açığa alındı ama HSYK yetkililerinin, 23 Mayıs 2016 tarihinde Savcı Ahmet Biçer’in vefat ettiğinden haberleri bile yok. Halı sahada maç yaparken kalp krizi sonucu vefat eden Biçer, memleketi Yozgat’ta toprağa verildi. PKK terörünün yoğun olduğu Beytüşşebap’ta da görev yapmıştı. HSYK seçimleri yapıldığında “Yargıda Birlik Platformu”nun aleyhinde faaliyette bulunduğu için kendisini dostça uyaran arkadaşları da olmuş. Listeler incelenince “Yargıda Birlik Derneği”nin üyesi olmayanların açığa alındığı da dikkat çekiyor.

12 yıllık Savcı Ahmet Biçer’in 57 gün önce vefat ettiğinden bile habersiz olanların, onu öldükten sonra “mezarda açığa almaları” karşısında ne düşünürsünüz? Durun daha bitmedi.

Açığa alınanların listesini incelediğimizde, bu listelerin iki yıl önce düzenlendiğini anlıyorum. Çünkü görev yerleri hanesinde, iki yıl önce görev yaptığı yerler yazılı… Fethullah Terör Örgütü (FETÖ) Paralel Devlet Yapılanması (PDY) üyesi olarak gösterilen isimler arasında YARSAV üyeleri, sosyal demokrat 1. sınıf hakim ve savcıların da bulunduğu anlaşılıyor.”

Saygı Öztürk’ten sonra, Savcı Biçer’in ihracını TBMM gündemine taşıyan CHP Artvin milletvekili Uğur Bayraktutan, Adalet Bakanı’nın cevaplandırılması istemiyle bir soru önergesi verdi. Bayraktutan verdiği önergede, “ihraç listelerinin kamuoyunda dillendirildiği gibi aylarca önceden hazırlanıp daha sonra uygulamaya geçildiği iddiaları doğru mudur?” ifadelerine yer verdi.

Binlerce hakim ve savcının 15 Temmuz 2016 darbe girişiminin gerçekleştirildiği gece, darbe girişiminin başlamasından sadece birkaç saat sonra HS(Y)K tarafından ihraç edilmesi nedeniyle, hakim ve savcıların darbe girişiminden çok önce hazırlanan listelere dayanılarak ihraç edildiği iddiası kamuoyunda yoğun bir şekilde tartışılmış, ancak bu iddiaya ilişkin hükümetten kamuoyunu tatmin edici herhangi bir açıklama yapılmamıştı.

NEWS | No hot or tap water has been providing to 6th unit of Istanbul Silivri Prison where judges and prosecutors have been kept

On social media, a twitter account named “Mağdur Mesajları @magdurmesaji” has raised the issue of unlawful treatments against imprisoned judges and prosecutors in Silivri Prison.

According to the report, no hot or tap water has been providing to 6th unit of Silivri Prison, where judges and prosecutors have been kept and 41 inmates have been holding in the ward having 20 persons capacity. The meal provided to 41 persons is barely sufficient for 25 persons only. Due to inadequacy, two persons have to use the same cabinet. Moreover, since there are not adequate beds for each, they sleep on the ground or have to put the bunks together.

Ömer F. Gergerlioğlu, human rights activist and spokesman of right and justice platform, has brought up the issue to the agenda and reacted too strongly on twitter. Mentioning his twit to Justice Ministry, he has called the Ministry to deal with the matter. In his twit, he used the sentences of “there are complaints that no water has been provided to the ward where 41 judges and prosecutors kept. Arbitrary water cut has been issued all the time. Do not test people with lack of water! Is it an old habit coming from Kerbela ?, @adalet_bakanlik ”.

The Justice Ministry has not made any statements so far.

Sosyal medyada Mağdur Mesajları isimli twitter hesabında Silivri Ceza İnfaz Kurumlarında tutuklu bulunan hakim ve savcılara yönelik hukuka aykırı uygulamalar gündeme getirildi.

Habere göre, Silivri 6 Nolu Ceza İnfaz Kurumu’nda hakim ve savcıların tutulduğu koğuşa soğuk ve sıcak su verilmemekte, kapasitesi 20 kişilik olan koğuşta 41 kişi barındırılmakta, 41 kişi için sadece 25 kişiye yetecek kadar yemek verilmekte, koğuşta yeterli dolap olmadığından bir dolabı iki tutuklu kullanmakta, ayrıca tutuklu sayısınca yatak bulunmamakta, bunun sonucu olarak tutuklular yerde ya da ranzaları birleştirerek yatmak zorunda kalmaktadır.

İnsan hakları aktivisti ve Hak ve Adalet Platformu sözcüsü Ömer F. Gergerlioğlu twitter hesabında konuyu gündeme taşıyarak, yapılan uygulamalara tepki gösterdi. Attığı twiti Adalet Bakanlığı’na da mention yapmak suretiyle, Bakanlığı konuyla ilgilenmeye çağıran Gergerlioğlu twitinde, ” Silivri cezaevinde 41 hakim savcının kaldıgı kogusa var olan suyu vermediklerine dair sikayetler var. Sürekli keyfi kesinti yapiliyormus. Suyla imtihan etme..! Kerbela’dan kalma alışkanlık mı? @adalet_bakanlik” ifadelerini kullandı.

Adalet Bakanlığı konuyla ilgili henüz bir açıklama yapmadı.

Yüzde 98 engelli iki çocuğun babası eski Kocaeli savcısı Seyfullah Çakmak 17 Temmuz’dan beri tutuklu.

‘FETÖ’ soruşturması çerçevesinde tutuklanan Çakmak, çocuklarının özel durumundan dolayı defalarca tutuksuz yargılanma talebinde bulunmasına rağmen dokuz ay sonra iddianame hazırlanmış ve tutukluluğunun devamına karar verilmişti.

Engelli aylığına da engel getirildiği konuyu yakından takip eden Ömer Faruk Gergerlioğlu tarafından gündeme getirilmişti.

Ancak konunun kamuoyunda gündem olmasından sonra engelli aylığı başvurusu aylardır reddedilen ileri derecede engelli çocukların engelli aylığı tekrar bağlanmıştı.

Gergerlioğlu, farklı yazılarında engelli çocukların babalarının durumundan dolayı bir yıkıma uğradığını anlatırkken Silivri’den memleketi Kocaeli T Tipi Cezaevi’ne gönderilmek istediğini yazmıştı.

Çakmak, yarın ilk kez mahkemeye çıkacak.

Gergerlioğlu, bir kez daha sosyal medya hesabından bu davaya dikkat çekerek, “Yüzde 98 engelli bu iki yavrumuzun babaları, eski savcı Seyfullah Çakmak uyduruk gerekçelerle 23 aydır tutuklu. Çocuklar hep hasta, bakımları çok zor, anne bitmiş durumda. Yarın ilk mahkemesi var. Defalarca yazdım… YETER ARTIK ONU BIRAKIN..!” diye yazdı.
