Judges and public prosecutors are both the victims and supporters of the regime in Turkey that is becoming more authoritarian day by day.
There is an easy explanation for this great contradiction: The government that used the failed coup attempt as a means to create a judicial system that is in total control of the AKP- regime, even before identifying the perpetrators of the coup attempt, arrested thousands of judges and prosecutors who were blacklisted as opponents, using the other judges and prosecutors who are aligned with the government.
While judges and prosecutors who got their colleagues arrested without hesitation are put on fast track for promotion, blacklisted judges and prosecutors have been waiting for the justice over 4 years are being kept in jail cells.
There are many female judges and prosecutors among members of the justice system who are ignored by the society that they once dispensed justice.
Spending most of their life in courtrooms dispensing justice and refusing to be in the spotlight with their humble life styles, jailed female judges whose names and stories unknown to the public are the clear examples of the brutality of the regime. Nesibe Özer, Ayşe Neşe Gül, Yeşim Sayıldı, Neslihan Ekinci and many more.
Nesibe Özer
Justice Nesibe Özer served as the Head of the Second Department of the Supreme Board of Judges and Prosecutors (now Board of Judges and Prosecutors-BJP) between 2010-2014. At the term she served with the vision of European standards, she was widely acclaimed by her colleagues.
In the 2014 elections of the BJP, she ran independently against the candidates of the Unity in Justice Platform (UJP), which was formed by the regime to guarantee the election of the candidates who are aligned with the regime. She secured vote of 4545 judges and prosecutors but was unable to be elected.
Özer, whose name is on top of the purge lists, was immediately arrested right after the 15 July coup attempt. Placed in a solitary confinement cell, Özer protested the inhuman conditions of her cell by going on hunger strike(1). It has been two years and three months since she was arrested but her trial has not begun yet.
Ayşe Neşe Gül
Ayşe Neşe Gül also ran against the candidates of the UJP in the BJP elections of 2014 and secured 4816 votes but was unable to win. Targeted by the regime after the elections, her husband, Public Prosecutor Mr. Cevat Gül, and she were both arrested in the following days of 15 July coup attempt. Two years after their arrest, indictments -perfectly described by the famous jailed journalist Ahmet Altan as “Porn of Justice”- were filed and trials of Mr. and Mrs. Gül have begun. Now each one is facing 3 consecutive sentences of aggravated life imprisonment(2).
Neslihan Ekinci
Neslihan Ekinci is another female judge who is in the target list of the regime. Judge Ekinci, former Assistant Secretary General of the BJP and her husband, Hüseyin Ekinci- former Senior Rapporteur of the Constitutional Court (Phd)- were arrested immedieatly after the coup attempt.
Ekinci couple has been kept in separate solidary confinement cells. Being unable to bear the “specifically” aggrevetad conditions of the cell by the regime Neslihan Ekinci was taken to Bakırköy Psychiatric Hospital and treated for a while. Rana, daughter of Ekinci, is hoplessly trying to tell the unjust treatment of her parents to the public. Stressing that her mother was not given a single book, Rana Ekinci tweeted and screamed ” My mother came to the point of loosing her mind”(3). One of the persons who heard this clamour was Jan Walters who is a member of Amnesty International and a lawyer. She read his letter addressing the Neslihan Ekinci and expressed their support against all injustices she was subjected to and said “Stay Strong” in front of cameras. (4) After many years in prison she was released on the condition of judicial control. She was sentenced to 7,5 years in prison and is waiting for Appeal Court judgement. When Appeal Court upholds the first instance court decision she will be put into prison again.
Yeşim Sayıldı
Yeşim Sayıldı is an another woman who is forgotten in the cells of the Turkish Jails. When she was appointed as the Head of Commission of Istanbul Anadolu Justice Palace (One of the largest court complex in Europe) Sabah, a newspaper now acts as the speaker of regime, reported the news with following headline “Women’s Voice in the Aisles of the Court”. The news read ” Appointment of Yeşim Sayıldı, staunch defender of women’s rights, put a smile of the faces of female judges and prosecutors”(5).
She became a target by the regime as she announced her candidature for the membership of BJP in 2014. She was not able to secure the necessary vote but 5009 judges and prosecutors voted for her. Just like other BJP canidates, her husband Prosecutor Selçuk Sayıldı and she were arrested because of the 15 July coup attempt. She has been waiting for the day that the justice will be served for last 2 years and 3 months in a cell in which she was placed illegally.
Abovementioned names were given just as a few examples. The list of arrested female judges is quite long. Lives of these female judges who were the face of western and universal values of the Turkish Judiciary have been turned upside down as the Erdogan regime got further away from the universal values such as human rights, fair procedural trial rights, rule of law, and democracy.
All judges and prosecutors who were tought to be continue fighting for the independent judiciaal system and cannot be subdued, have been purged by the regime so that rest would be in their disposal. Regime achieved its aim. Today, talking about independent and impartial judiciary in Turkey is no longer possible.
Moving towards the unknown in the jail cells of Turkey, female judges, once representative of justice, have been waiting for the justice.

Bu büyük çelişkinin kolay anlaşılabilir bir açıklaması var: 15 Temmuz darbe girişimini kendisine bağlı bir yargı oluşturmak için bahane olarak kullanan iktidar, darbecilerin dahi kimliklerini belirlemeden önce, daha önceden muhalif olarak fişlediği binlerce hakim ve savcıyı, kendisine bağlı diğer hakim ve savcılar eliyle gözaltına aldırıp tutuklattı. Kendi meslektaşlarını hukuksuzca tutuklamakta tereddüt etmeyen hakim ve savcılar hızlı bir şekilde terfi ederken, fişlenen hakim ve savcılar 2 yılı aşkın bir zamandır cezaevi hücrelerinde tutuluyorlar.
Uzun yıllar adalet dağıttıkları toplum tarafından adeta görmezden gelinen bu yargı mensupları arasında çok sayıda kadın hakim var. Hayatlarının çoğu mahkeme salonlarında adalet dağıtmakla geçen, mütevazı yaşamlarıyla görev yaptıkları dönemlerde dahi medyada çok yer almayan, çoğunun ismi ve hikayesi kamuoyu tarafından pek bilinmeyen hücrelerdeki kadın hakimler, iktidarın acımasızlığının adeta ete kemiğe bürünmüş halidir. Nesibe Özer
Hakim Nesibe Özer, 2010-2014 yılları arasında HSYK (şimdi HSK) 2. Dairesi Başkanı olarak görev yaptı. Yargıda Avrupa standartları vizyonuyla görev yaptığı dönemde birçok meslektaşının takdirini topladı. İktidarın 2014 yılı HSYK üyesi seçimlerini kendisine yakın yargı mensuplarının kazanması amacıyla kurdurduğu Yargıda Birlik Platformu (YBD) adaylarının karşısında, bağımsız aday olarak yarıştı. 4545 hakim ve savcının oyunu almasına rağmen üye olarak seçilemedi. İktidarın tasfiye listelerinde en ön sıralarda yer alan Özer, 15 Temmuz darbe girişimi sonrasında derhal tutuklandı. Cezaevinde bir hücreye konulan hakim Özer, ağır hücre koşullarını açlık grevine giderek protesto etti. (1). Tutukluluğunun üzerinden 2 yıl 3 ay geçmesine rağmen, Özer’in yargılanmasına hala başlanmadı.
Ayşe Neşe Gül
Ayşe Neşe Gül, iktidarın 2014 yılı HSYK seçimlerinde YBD adaylarının karşısında, bağımsız aday olarak yarıştı ve 4816 oy aldı. Bu sayı üye olarak seçilmesine yetmemekle birlikte, seçim sonrası iktidarın açık hedefi olan Gül, eşi savcı Cevat Gül ile birlikte 15 Temmuz darbe girişiminden sonra tutuklandı. Gül çifti hakkında tutuklandıktan yaklaşık 2 yıl sonra, tutuklu gazeteci Ahmet Altan’ın enfes benzetmesiyle, “hukuk pornosu” niteliğinde bir iddianame düzenlendi ve ayrı ayrı üçer kez ağırlaştırılmış müebbet hapis cezası ile cezalandırılmaları istemiyle dava açıldı. Neslihan Ekinci
Neslihan Ekinci, iktidarın hedef tahtasında yer alan bir diğer kadın hakim. HSYK eski Genel Sekreter Yardımcısı olarak görev yapan Hakim Ekinci, Anayasa Mahkemesi Baş Raportörü olarak görev yapan eşi Hakim Dr. Hüseyin Ekinci ile birlikte darbe teşebbüsü sonrasında tutuklandı. Ekinci çifti yaklaşık 2016 Temmuz’undan bu yana cezaevinde ayrı ayrı hücrelerde tutuluyorlar. Cezaevinde iktidar tarafından ‘özel’ olarak ağırlaştırılan koşullara dayanamayan Neslihan Ekinci Bakırköy Ruh ve Sinir Hastalıkları Hastanesine kaldırılarak bir süre burada tedavi gördü. Ekinci’nin kızı Rana Ekinci twitterdan anne ve babasının mağduriyetini umutsuzca kamuoyuna duyurmaya çalışıyor. Bu twitlerinde bir yıldan daha uzun bir süredir annesine kitap verilmediğini belirten Rana Ekinci, “Annem aklını kaybetme noktasına geldi.” diyerek adeta feryat etti. (3) Bu feryadı duyan isimlerden Uluslararası Af Örgütü üyesi Avukat Jan Walters, kameraların karşısına geçerek Neslihan Ekinci’ye yazdığı mektupta yapılan haksızlıklara karşı kendisini desteklediklerini sesli ve yazılı olarak ifade etti ve “güçlü ol” dedi. Yeşim Sayıldı
Türkiye’nin cezaevi hücrelerinde adeta unutulan bir diğer kadın hakim ise Yeşim Sayıldı. 2013 yılında İstanbul Anadolu Adalet Sarayı Komisyon Başkanlığı’na atandığında, bugün iktidarın sözcüsü olan Sabah gazetesi tarafından “Adliye Koridorlarında Topuk Sesleri” başlığıyla yayınlanan haberde “kadın hakları konusunda duyarlı biri olan Yeşim Sayıldı’nın komisyon başkanı olarak atanması kadın hakim ve savcıların yüzünü güldürdü.” ifadelerine yer verilmişti. (5) 2014 yılında iktidarın HSYK adaylarının karşısında bağımsız olarak adaylığını açıklamasıyla birlikte, iktidarın hedefi haline geldi. HSYK üyesi seçilmek için yeterli olmamakla birlikte, toplam 5009 hakim ve savcının oyunu aldı. Diğer HSYK adayları gibi, Sayıldı da, eşi Savcı Selçuk Sayıldı ile birlikte 15 Temmuz darbe girişimi bahanesiyle tutuklandı. Hukuksuzca konulduğu cezaevi hücresinde 2 yıl 3 aydan beri umutsuzca adaletin tecelli edeceği günü bekliyor.
Yukarıdaki bu isimler sadece örnek olarak yazıldı. Bu isimler dışında, hücredeki kadın hakimlerin listesi oldukça uzun. Modern Türkiye’nin batılı evrensel değerlere dönük yüzününün temsilcileri olan bu kadın hakimlerin hayatları, gücü tamamen ele geçiren Erdoğan Rejimi’nin insan hakları, hukukun üstünlüğü ve demokrasi gibi evrensel değerlerden yüzünü çevirmesiyle birlikte altüst oldu. Siyasi iktidar yargıyı tamamen kendine bağlamak için, kendisine bağlayamayacağına, bağımsızlık mücadelesine devam edeceğine kanaat getirdiği hakim ve savcıları tasfiye etti. Amacına da ulaştı. Bugün Türkiye’de bağımsız ve tarafsız yargıdan bahsetmek mümkün değil.
Bugün bir bilinmezliğe doğru yol alan Türkiye’de bir zamanlar adaletin temsilcileri olan kadın hakimler, cezaevi hücrelerinde adalet bekleyişine devam ediyorlar.

Hakimler ve Savcılar Yüksek Kurulu (HSYK) eski Genel Sekreteri ve eski Yargıtay Üyesi Mehmet Kaya 2 Ekim 2018’de hakim(!) karşısına çıktı.
Yargıtay 9. Ceza Dairesince, Yargıtay Genel Kurul Salonu’nda görülen duruşmada Abdurrahman Orkun Dağ’ın heyet başkanlığı yapması dikkat çekti. Dağ, Cumhuriyet Gazetesi yazarları hakkında mahkumiyet kararı vermiş; Anayasa Mahkemesi’nin hak ihlali kararına rağmen Mehmet Altan’ı tahliye etmemişti. Siyasi davalarda iktidar muhalifleri aleyhine verdiği kararlarıyla ünlenen Dağ, üyelerinin tamamı iktidar partisi tarafından seçilen Hakimler Savcılar Kurulu (HSK) tarafından 16 Temmuz 2018 tarihinde Yargıtay üyeliğine terfi ettirildi. Yargıtay’da da henüz iki aylık kıdemle, teamüller çiğnenerek, 9. Ceza Dairesi’nde heyet başkanlığına getirildi. (1)
Tutuklu yargılanan Yargıtay üyesi Mehmet Kaya’nın duruşmasındaki tavırlarıyla ‘bağımsız ve tarafsız olmadığı’ yönünde eleştirilere hedef olan Dağ, duruşma sırasında sık sık Kaya’nın savunmasına müdahale etti.
Savunma için söz verilen Mehmet Kaya, usule ilişkin itirazlarını dile getireceğini, dosya tam olarak eline geçmediği için esas hakkındaki savunmasını daha sonra yapacağını belirtti.
Avukat istemediğini, ancak CMK’dan atanan zorunlu avukatı bulunduğunu ifade eden Kaya, hukuktan bahsetmeye devam edeceğini söyledi. Kaya, Avrupa İnsan Hakları Sözleşmesi (AİHS), Avrupa İnsan Hakları Mahkemesi (AİHM) ve diğer uluslararası sözleşme ve etik kurallar gereği hukuk adamlarının uyması gereken kurallar bulunduğunu anlattı.
Kaya, Türkiye’nin, Anayasa’nın 90. maddesi gereği, insan haklarına uyma yükümlülüğünü kabul ettiğini, ancak buna rağmen katı pozitivist hukuk anlayışının egemen kılınmaya çalışıldığını ileri sürdü.
Anayasanın başlangıç kısmında hukuk devleti ilkelerinden, insan onurundan bahsedildiğini anlatan Kaya, bugün hukuksal pozitivizmin mi yoksa insan haklarına dayalı hukukun mu uygulanacağı sorusunun sorulduğunu savundu. İnsan haklarına dayalı hukuku uygulamamanın tam bir haksızlık olacağını belirten Kaya, ülkelerin insan hakları bağlamında AİHS ilkeleri ve AİHM içtihatlarına uymaları gerektiğini kaydetti.
Bu sırada, Mahkeme Başkanı Dağ, “Sizden burada ders almayacağız” diyerek Kaya’yı uyardı. Kaya’nın, “Savunmamı kısıtlayamazsınız, kesemezsiniz” diyerek, savunmasına aynı şekilde devam etmesi üzerine Başkan Dağ, bu kez “Savunmanızı size yöneltilen isnatlarla ilgili yapın. İlliyetsiz şeyler söylüyorsunuz.” uyarısında bulundu.
Sanık Mehmet Kaya ise “İhsası reyde bulunuyorsunuz” diyerek, Mahkeme Başkanı Dağ ile ilgili reddi hakim talebinde bulundu.
Talep üzerine Başkan Dağ, duruşmaya ara verdi. Aranın ardından, Başkan Dağ, sanığın savunma dışındaki sözlerinin ve reddi hakim talebinin duruşmayı uzatma amacına yönelik olması nedeniyle geri çevrilmesine karar verildiğini açıklayarak, duruşmaya devam etti.
Mehmet Kaya ise “Hakkımda verilecek cezayı biliyorum, hukuki görüşlerimi ifade etmeye devam edeceğim” diyerek savunmasını sürdürdü.
AİHM’in adil yargılanma hakkının kısıtlanmasıyla ilgili ülke kararlarından örnekler veren Kaya, “Binlerce hakimin listeler gönderilerek tutuklanmasına yol açan bu durumla ilgili elbette hukuk yoluyla bir yüzleşme olasıdır.” dedi.
İnsan haklarına dayalı hukukun uygulanması talebini dile getirdiğini, dile getirmeye de devam edeceğini aktaran Kaya, uygulamadaki yanlışlıkları anlatmaya çalıştığını belirtti.
Ankara Cumhuriyet Başsavcılığının hakkında suçüstü hükümleri uygulayamayacağını, hakkında soruşturma yürütenlerin bu yetkisinin bulunmadığını iddia eden Kaya, “Benden daha kıdemsiz tek bir hakimin, hakkımda düzenlediği belgeyi kabul etmiyorum. Yargıtayda KHK ile bir daireye beni yargılama yetkisi veriliyor. Bu hukuk mudur? Yapılanlar, anayasaya, uluslararası sözleşmelere, AİHM içtihatlarına aykırıdır, meşru değildir.” iddiasında bulundu.
Mehmet Kaya, “Bu mahkemenin yargılama yetkisini kabul etmiyorum. Yürütmenin müdahalesiyle sırf bu davalara bakmak için yetkilendirilmiştir. Bağımsız da değildir. Türk yargısı koşar adım bağımsızlığını kaybetmeye doğru gidiyor. 9. Ceza Dairesi de bağımsızlığını kaybetti, çünkü özel olarak seçildi. Bağımsızlığı olmayan bir mahkemenin tarafsız olamayacağı da açıktır.” diyerek de heyetin reddini istedi.
Bu talep üzerine de duruşmaya ara veren Heyet, aranın ardından bu talebin de duruşmayı uzatmaya yönelik olduğunu belirterek reddetti.
Savunmasına devam eden Kaya, hayatının hiçbir döneminde demokratik olmayan bir şeyin içinde yer almadığını ileri sürerek, “Sıkıyönetim listelerinden bahsediliyor. Darbe sonunda bana görev verilseydi kabul etmezdim. 2 ay HSYK Genel Sekreteri olmamak için direndim. Hiçbir zaman makam peşinde olmadım. Üye seçilirken de savcı olmak istemiştim.” dedi.
Aranın ardından usule ilişkin savunmasını tamamlayan Kaya’ya, esas hakkındaki savunması için gelecek duruşmaya karar süre verildi. Kaya’nın avukatının tahliye talebi reddedilirken, duruşma ertelendi. (2)

Special Terror Chamber ruled continuation of pretrial detention for former vice president of Turkish Top Court Alparslan Altan on 27 September 2018 over the pretext of terrorism charges.(1)
Who is Alparslan Altan?
He completed his primary and secondary education in the province of Çayıralan in Yozgat in 1985. After graduating from the Faculty of Law at Istanbul University in 1989, he completed his advocacy internship and judicial training until 1993. Respectively; he worked as prosecutor in Alaplı, Hilvan and Zara public prosecutor’s office.
He completed his LLM degree with the thesis of “Responsibilities of the Members of the Board of Directors in the Joint Stock Companies and the Effect of the Quietus in the cases of Liability” in Erciyes University, Faculty of Economics and Administrative Sciences, Department of Commercial Law, and his phd degree with the thesis of “Private Property, Security and Protection” in Gazi University Institute of Social Sciences Private Law Department.
Altan, who served as the Constitutional Court Rapporteur between 9 January 2001 and 25 February 2010, was appointed as Deputy Undersecretary of Maritime Undersecretary on 26.2.2010. He was appointed as a substitute member of the Constitutional Court by former President Abdullah Gül on 29.03.2010. He became a Constitutional Court Member after the referendum held on September 12, 2010. Altan, chosen as vice president of the Constitutional Court on 26 October 2011. Until 2015, he served his duty as vice president.
He gave seminars on Constitutional Law and Constitutional Judiciary, Objection in Constitutional Law, Human Rights in Decisions of European Court of Human Rights at The Justice Academy of Turkey. There are various articles he has published in the fields of constitutional justice and private law.
He is married and father of two children. His elder son Eren is a disabled child. Eren had a seizure when his father was taken into custody.
He was arrested based on his “social circle”!
Following the failed coup attempt on July 15, 2016, he was one of the first civilian/judge to be arrested illegally in the history of law and coup. Jd Alparslan Altan was detained by the Ankara 4th Criminal Judgeship of Peace in Ankara on the morning of 16th of July in the presence of the Ankara chief prosecution office, who had no authority to prosecute members of the high judiciary.
Altan, who had to be trialed by the supreme criminal tribunal in accordance with the law and who could not be investigated by any of the prosecutor’s offices, was dismissed without even considering taking his defence with the decision of president and members of Top Court in defiance of ECHR (european court of human rights) and the ECHR (european convention of human rights.) As a reason for sack, the criterion shown as members opinion that formed “social circle knowledge” which had no place in the law. Since the Hitler period, this rationale was firstly considered as a reason for a high/top judge to be sacked in the Turkish judiciary, which is an adapted notion of daily language term ‘gossip’ into the legal literature as ‘social knowledge’. On the other hand, the decision shows that there is no solid evidence about the lack of concrete evidence.
Altan was known to vote for release of prominent journalist Can Dundar who is in exile in Germany
Altan, is known for his decisions and conter votes on behalf of freedoms in the decisions of Youtube, arrested MPs, prep school, Can Dündar, Erdem Gül. With this stance, he shows he is judge that in favor of freedoms. His counter votes bears enough law experience which can be taught as a lecture in law faculties. Unlike the current members, he was known not to swear allegiance to executive, and as a result, he was dismissed from the profession and arrested.
The “social circle” statement, which the Top Court president and members indicated as the reason for the sack, was used as the reason for the dismissal of judges who had not previously obeyed to Hitler in Nazi Germany.
On the other hand, Altan’s objection to the detention and the demand for release are almost reversed despite the need of her disabled son by adding hundreds of names with copy and paste system.(2)

The General Assembly of the European Bars Federation (FBE) in Warsaw September 22, 2018, which represents 250 member Bars of Europe and their one million member lawyers, expressed its grave concerns for the present situation of judges, prosecutors, lawyers and journalists in Turkey as follows:
“In accordance with the FBE previous and constant position we definitely call upon an end to arbitrary arrest, detention, and prosecution of judges, lawyers and journalists.
We again call for an end to the use of torture and ill treatment by state officials and the investigation of such crimes.
We demand the full protection of independence of the legal and journalism professions in Turkey, and the respect for human rights of judges, lawyers and journalists and we give our full support to our colleagues in Turkey.”

Former chief Ankara-West prosecutor and candidate member of High Council of Judges and Prosecutors (HCJP) Murat Gökçe was sentenced to 8 years 9 months in prison over the pretext of terrorism charges on 28 September 2018.
Gökçe denied accusations and requested his release. However, special terror court sentenced him and ruled continuation of his detention during appeal process.

Yaklaşık 27 aydan beri tek kişilik hücrede tutulan Alçık, safrasında taş bulunmasına, hücresinde bayılmasına ve diğer ciddi sağlık sorunlarına rağmen tahliye edilmemesi bir yana hücreden dahi çıkarılmıyor.
Yüzlerce meslektaşıyla benzer kötü koşullarda Keskin Ceza İnfaz Kurumu’nda tutulan Alçık, kızına gönderdiği mektupta cezaevindeki hücresini çizip, altına da tasvirini yazdı:
“İşte kabataslak odamdaki eşyalarımın yeri ve neler olduğu: Solda yatağım, yanında elbise dolabım, sandalyem, sandalyemin üzerinde radyom. Dolabımdaki kalp Elif’in gönderdiği postit ve üzerinde ketıl ve çaylarım, yanında çöp kovası, mutfak eviyesi ve musluk, zeytinyağım, bulaşık deterjanım, tabaklarım, hemen üstünde mutfak dolabım ve banyo-WC, banyonun kapısı görülüyor. Benim 24 SAATİM BURADA GEÇİYOR. MASAM YOK. Çünkü masayı tek kişilik odalara vermiyorlar.” (1)
İşte bir Yargıtay üyesinin yaklaşık son iki yılında gününün 24 saatini geçirdiği hücre böyle.
Alçık hücresinde yazdığı, “Alışamadım Bir Türlü” isimli şiirinin bir kısmında ise:
“Alışamadım bir türlü
Beş adımda geri dönmeye
Onbeş metrekarelik odamda
Geçirdiğim iki yıla karşılık …” diyerek keyfi esaretine adeta isyan ediyor.
Hukukçular; Yargıtay, Danıştay, Anayasa Mahkemesi üyeleri ve tutuklu binlerce hakim ve savcının mevcut durumunun, tutuklu hakimlerden çok, hala yargı mensubu olarak görev yapan hakim ve savcılara yönelik siyasi iktidarın tehdit ve korkutma mesajı niteliğinde olduğu görüşündeler.
