Bir okur mektubunun başına sonuna birkaç cümle eklersin, mektubu olduğu gibi yayımlarsın ve günü kurtarırsın… Hayır. Bu yazı günü kurtarmak için filan yazılmıyor. Parantezi kapatıyorum).

16 Temmuz’da HSYK kararı ile açığa alınmış, ardından açığa alındığı için mahkemece tutuklanmış, tutuklandığı için de yine HSYK kararı ile meslekten ihraç edilmiş…
Adı: Kadri Atalay. Tanımıyorum. Siyasi görüşünü bilmiyorum. Tutuklanma gerekçesini de meslekten ihraç gerekçesini de bilmiyorum…
Bilmem de gerekmiyor. Yazının başlığında yazılı: Tutun ki Cemaat üyesi yada sempatizanı. Hatta tutun ki FETÖ’cü. Hiçbir gerekçe bana, sana, bize birinin 487 gündür iddianamesi yazılmadan hapishanede tutulmasını açıklayamaz.
Gazetecinin bir görevi de mağdurların sesi olmaksa, işte ses:

487 günlük iddianamesiz, yargılamasız bir tutukluluk ise kesinlikle mağduriyettir, adaletin acımasızca çiğnenmesidir.
Şimdi çok az kısaltarak mektubu sunuyorum:

Muhterem Aydın Engin beyefendi, bendeniz bu dönemin klasiği cümlesinden olmak üzere Afyonkarahisar / Dinar T Tipi Ceza İnfaz Kurumu’nda tutuklu olarak bulunmaktayım. Saydım, bugün itibarıyla 472 gün olmuş (Mektup 1 Kasım tarihliydi. O yüzden 472 – A. E.) Tahmin edeceğiniz üzere 15 Temmuz kahpe darbe girişiminin akabinde derdest edildim. Evvelce Afyon Adliyesi’nde aile hâkimi olarak görev yapıyordum …… HSYK mezkur tutuklama kararını gerekçe göstererek 64 sayfa olarak kaleme aldığı bir kararla ekli listeye adımızı ekleyip bizi ihraç etti. Sonra cezaevindeki diğer meslektaşlar da noktasıyla virgülü ile aynı 64 (altmış dört) sayfalık gerekçeye onların adları eklenerek, savunma filan alınmadan ihraç edildiler.
İşte efendim, size kısa künyemi böylece arz ettim. O gün bugündür tecritteyim. Tek kalıyorum. Sağ olsunlar bizim rahatımız düşünüldüğü için tek kişilik bir oda verdiler. Allah sıralı büyüklerimizden razı olsun, Allah devlete millete zeval vermesin……
Tutuklu yargıç Kadri Atalay bu satırların ardından bize, yani Cumhuriyet gazetesine övgüler yağdırıyor: “… Bu devrin sınavını verip alnının akıyla meydanda kalan tek ceride sizsiniz” diyerek teşekkürler ediyor.
Bana da “Yargılamadan, iddianame bile yazmadan bir yargıcı 487 gün hapishanede tutmayı adaletle kim, nasıl bağdaştırabiliyor ve kim buna rağmen gözlerimizin içine baka baka ‘Türkiye bir hukuk devletidir ve yargı bağımsızdır’ diyebiliyor”u sormak kalıyor.

Masamda birikmiş yüzlerce “mapushane mektubu”ndan birini, üstelik biraz da kısaltarak aktardım.
Kadri Atalay tek ve özel bir örnek değil. Halen 2400 yargıç demir parmaklıklar ardında, iddianamesiz, yargılamasız yatmaktalar. 4600 yargıç savunmaları alınmaksızın meslekten ihraç edildi. Her birinin yukarıda aktardıklarıma benzer öyküleri var.
Bana ulaşmamış binlerce ve binlerce (yüz binlerce?) mağdurun varlığını ben de, biz de, hele bu ülkenin Adalet Bakanı da, onun da üstündeki yetkili ve etkili kişiler de biliyor.
Bugünkü Tırmık bir adalet çığlığı olmaya çabaladı.
Tutukladıysan iddianamesini yaz, suçunun kanıtlarını ortaya koy, yargıla. Yoksa tutukluluk artık cezaya dönüşmüş ve bütün dünya ülkelerinde geçerli olan bir hukuk ilkesi açıkça çiğnenmekte demektir:
Geç gelen adalet, adalet değildir…

NEWS| Unfortunate statements of Murat AYDIN, Vice President of YARSAV about “the booklet” consist of orders of Justice Ministry to the courts

Murat AYDIN, vice president of dissolved YARSAV answered the questions of the radio programmer Yavuz Oghan as to the allegation raised into issue by main opposition party leader Kemal Kılıçdaroğlu which is about “the booklet” prepared by Justice Ministry and including an instruction for the judges to make their “release decisions regarding arrested judges and prosecutors in consultation with HSK. (Board of Judges and Prosecutors)

Murat AYDIN made statements about this booklet as follows:

This statement mentioned in the booklet in question which was handed out to the judges and prosecutors is only a presentation, not having a binding force due to not being a ‘circular’. The Justice Ministry had issued some circulars in the past as well for the prosecutors not to make procedural mistakes during the investigations. ‘If this is done for the public prosecutors in order to ensure the unity in implementation of law accross the country, this is quite normal’.

Furthermore, HSK also conducted ‘administrative investigation’ into these judges and prosecutors. Accordingly, ‘HSK might have gathered further different evidences’ rather than the prosecutor’s office and the courts. So, the prosecutors conducting the investigations concerned have to request information from both HSK and other administrative organs. Besides investigations, ‘if the prosecutors request release for their arrested colleagues during hearings, they might also ask for these evidences from HSK’. ‘If what the Justice Ministry says consists of this, that’s okay’. However, it can not be acceptable, if the subject of this booklet is the judges.

On the other side, after the case is brought, the judges of its own motion, as it should be, might ask for evidences from other institutions as a requirement of the evidence inquiry obligation. The main problem here is that the current situation of the judiciary makes us more doubtful and responsive to the handouts like this. ‘Under normal circumstances, it is an issue out of any problem’.

In my opinion, this is not an internal legislation but an annotation. A judge should issue the verdict in accordance with the law regardless of any kind of influence. However, a judge should also be granted the ‘judicial guarantees’ so that s/he meets this obligation. The main issue on which we have to emphasize is the absence of these judicial guarantees. If the judges have those, their verdicts will not be as of concern.

The point to be considered is whether a judge getting this booklet can make an independent decision or not. For sure, that booklet may influence the judges under the current conditions. However, subjecting the judges and prosecutors to all kind of pressure, leaving them alone with their professional awareness will not be the guarantee for the citizens. At this point, the worth-stressing is whether the judicial system is operating properly or not.

Because of the reason that the judges and prosecutors do not have judicial guarantees, every verdict they issue will give rise to discussion even it is just and fair. ‘Normally, this workout of booklet should be considered as a training activity in order that the judiciary operates freely in conformity with law’, however, now, it is seen as a tool of pressure to influence the judiciary.

Today, what comes to mind of public opinion for every decision made by the judges is whether they give those decisions under politic motives or oppression of the executives. If we might well say that nothing can have an influence on the judges’ decisions and they have also guarantee, today we’ve become not talking about this issue saying that it is just a workout done by the Justice Ministry.

Let’s assume such a booklet does not exist. Do the judges exercise their judicial task freely or give judgement in accordance with their personal conviction and also feel themselves in safe with their verdicts today? This issue should also be considered. This fact shows us the responsiveness of the public pointing out a big problem in question is normal.

Furthermore, what to be discussed is not why the judges give unfair judgement but whether the atmosphere they are in let them to make fair decisions and also the reasons of it.

The statement of the president of TUSIAD (Turkish Industrialists’ and Businessmen’s Association) which was ‘I wish the economic growth actualized at a percent of 7 instead of 11 but this country experienced the rule of law, now’ presents a vital importance. Because the law concerns all fields of life.

If the people do not feel themselves in safe with the legal system, this causes polarization and separation. ‘If a judge can not give judgement in accordance with the law today, this is as of concern not for that judge but a society.’ “

HABER| Uluslararası 7 kuruluştan Türkiye’deki avukat ve hakimler için ortak bildiri

7 uluslararası hukuk kuruluşu Türkiye’de yargı alanında yaşanan zorluklara dikkat çekmek için ortak bir bildiri yayınladı.

İsviçre’nin Cenevre şehrinde Birleşmiş Milletler (BM) raportörünün de katıldığı bir etkinlikte okunan bildiri İnsan Hakları Konseyi’nde geniş yankı buldu. Ortak bildiri ayrıca BM İşkence ve Diğer İnsanlık Dışı Muameleler, Cezalandırmalar Özel Raportörü Nils Melzer ile paylaşıldı.

Ortak açıklamada kuruluşlar, darbe girişimi sonrası Türkiye’de yaygın şekilde işkence ve kötü muamele yapılması, işkence iddialarına yönelik etkili soruşturmalar yapılmayışı ve devam ede gelen işkence haberleri konularında endişelerini dile getirdi.

Bildiriye taraf olan kuruluşlar ayrıca Türkiye’de yargıç ve avukatların sistematikleşmiş keyfilikle gözaltına alınmalarından duydukları kaygılarını paylaştı. Kuruluşların ortak bildiri metni şöyle:

ORTAK BİLDİRİ

“Uluslararası Barolar Birliği İnsan Hakları Enstitüsü ve yedi ortak kuruluş, BM Özel Raportörü’nün Türkiye raporuna dikkat çekerek, Türk hükümetini raporda yer alan önerilerin uygulanmasını temin etmeye çağırmaktadır.

Darbe girişimi sonrası işkence ve diğer kötü muameleler hakkında etkili soruşturmalar yapılmaması ile ilgili ortak kaygılarımızı paylaşmaktayız. Bu hafta edindiğimiz Mersin İl Emniyet Müdürlüğü’nde 80 kişinin polis işkencesi gördüğüne yönelik haberde olduğu gibi bize ulaşan diğer işkence iddiaları sayısından derin endişe duyuyoruz.

Ayrıca Türkiye’deki avukat ve hakimlerin de sistematik keyfilikle tutuklanması kaygı verici. Güvenilir kaynaklara göre Temmuz 2016’dan beri yaşananlar şöyle:

– En az 1.525 avukat hakkında adli işlem başlatıldı, 578 avukat gözaltına alındı ve tutuklu yargılandı, 99 avukat ise hapis cezasına çarptırıldı.

– 4 bin 400’den fazla hakim ve savcı soruşturmaya tabi tutuldu, 2.400’den fazlası tutuklu yargılandı.

– Bu raporlar aynı zamanda hukukçulara yönelik işkence, kötü muamele ve ölçüsüz şekilde hücre hapsi uygulandığını ortaya koyuyor. Öyle ki yapılanlar kıdemli bir hakimin bir yıldan fazla hücre hapsinde kalması ve 17 meslektaşı ile birlikte tutuklanan bir avukatın cezaevi yetkilileri tarafından işkenceye uğraması hadiseleri ile vurgulanmıştır.

Son olarak, Trabzon Savcılığı 5 Ocak 2018’de verdiği kararla, 667 Numaralı Kanun Hükmünde Kararname’nin kamu görevlilerine Olağanüstü Hal (OHAL) yönetiminden dolayı görevleri dahilinde gerçekleştirdikleri davranışlardan, işkence ve kötü muamele dahil, ötürü sorumlu tutulmayacakları koruması getirdiğine hükmetmiştir.

İşkence ve kötü muamele uygulamalarına engel olmak ve bu eylemleri gerçekleştiren şahısları cezalandırmak devletlerin görevi olup uluslararası insan hakları hukuku kapsamında vazgeçilmeyecek haklardandır ve bu nedenle, hiçbir koşulda sınırlandırılamaz veya askıya alınamaz.

Özel Raportöre, işkence yapan kamu görevlilerine potansiyel koruma getiren düzenlemeyi soruşturması ve iyileştirme tavsiyelerinde bulunması çağrısını yapıyoruz.

Konsey’i aşağıdaki konularda Türkiye’yi uyarmaya davet ediyoruz:

-Hukukçuların maruz kaldığı haksız yargılama ve keyfi tutuklamalara son verilmesi ve bu konuda gerekli adımların atılması,

-Kamu görevlilerinin gerçekleştirdiği işkence ve kötü muamelelere karşı gerekli soruşturmaların başlatılması, sorumluların cezalandırılması ve bu uygulamaların bir an önce önlenmesi.

NEWS| Joint oral statement on the situation of lawyers and judges in Turkey

The IBA Human Rights Institute (IBAHRI), Lawyers for Lawyers (L4L), the Bar Human Rights Committee (BHRC), Union Internationale des Avocats (UIA), Lawyers Rights Watch Canada (LRWC), Judges for Judges (J4J), The Law Society of England and Wales, wrote a joint statement to highlight the ongoing challenges faced by the legal profession in Turkey.

The joint statement was addressed to the UN Special Rapporteur on Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment. It was read before the Special Rapporteur on 2nd March 2018 during a side event at the Palais des Nations in Geneva and widely circulated at the Human Rights Council.

Here is the full statement:

The International Bar Association’s Human Rights Institute and seven co-sponsoring organisations note the Special Rapporteur’s report on Turkey and call on the government of Turkey to ensure effective implementation of the recommendations.

We share concerns raised about the widespread use of torture and other ill-treatment in the aftermath of the attempted coup and the lack of effective investigations. We are deeply concerned by the gravity and number of reports of torture we continue to receive, such as the reports early this week of 80 persons tortured by the police at Mersin Provincial Security Directorate.

Also of concern are the widespread and systematic arbitrary arrests and detentions of judges and lawyers in Turkey. Reliable reports indicate that since July 2016:

– At least 1525 lawyers have been prosecuted, 578 have been arrested and kept in pre-trial detention and 99 sentenced; and

– More than 4400 judges and prosecutors have been investigated with more than 2400 put in pretrial detention.

These reports also indicate the use of torture, ill-treatment and excessive solitary confinement against legal professionals, which can be highlighted in the case of a senior judge held in solitary confinement for more than a year and a lawyer arrested with 17 colleagues who were allegedly tortured by prison officials.

Finally, on 5 January 2017, the Prosecutor’s Office in Trabzon ruled that Decree Law No. 667 grants State officials immunity for any act committed within their duties under the state of emergency decrees, including acts of torture and ill-treatment. The prohibition on the use of torture and the duty of states to prevent and punish torture are non-derogable rights under international human rights law and, therefore, cannot be limited or suspended under any circumstance. We call on the Special Rapporteur to investigate and recommend remediation of the potential impunity for torture granted to State officials.

We invite Council to urge Turkey to:

– Stop and remedy the arbitrary arrest, detention and wrongful prosecution of legal professionals; and

– Prevent, investigate and punish the use of torture and ill-treatment by State officials.

JUDGE ÖMER FARUK Ö. SENTENCED TO 8 YEARS 1 MONTH 15 DAYS IN PRISON ON 8 MARCH 2018

Dismissed and arrested judge Ömer Faruk Özatay was sentenced to 8 years 1 month 15 days in jail by Ankara 23th Assize Court for being member of armed terrorist organisation on 8 March 2018.

He joined hearing via video conferencing system (SEGBIS) from prison where he has been kept in since July 2016.

He was accused of using ByLock secure mobile messaging application which was publicly available on Google and Apple Stores.

He denied accusations and requested his acquittal.

After convicting and sentencing, court released him by considering his long detention period. He will be put in prison again if appeal courts uphold the conviction to serve remaining sentence.

The evidences against the dismissed judges and prosecutors not existing in files of the trial court are in evidence pool of HSK

Mehmet Yılmaz, vice president of the Board of Judges and Prosecutors (HSK), answered the questions of the journalists as to the allegation raised into issue by main opposition party leader Kemal Kılıçdaroğlu which is about “the booklet” prepared by Justice Ministry and including an instruction for the judges to make their release decisions in consultation with HSK.

Saying that the prosecutors in provinces have been carrying out the investigations into dismissed judges and prosecutors over the accusation of membership in armed terror organisation as a requirement of the provisions applied in “flagrante delicto” “without any evidence inquiry”, M. Yılmaz added also HSK has launched disciplinary proceedings into those dismissed judges and prosecutors.

He said that the evidences obtained within the context of these proceedings are gathered within a pool in HSK and added: “In that booklet the Ministry of Justice says the judges who will make the decisions in concerned investigations that if they issue the verdicts in consultation with HSK, they will get the evidences in pool of HSK. This is for both conducting the coup investigations more properly and also not doing harm with the rights of the defendants and the victims besides a fair trial. That’s the case”.

NEWS| THE HEARING OF MEHMET ÇELİK, THE IMPRISONED JUSTICE AT COUNCIL OF STATE

The arrested member of the Council of State (Supreme Administratice Court) Mehmet Çelik delivered his defense in the hearing held by 9th Penal Chamber of the Court of Cassation, acting as a first instance court, in general assembly hall of the Supreme Court. Justice M. Çelik, his relatives and lawyer appeared in the court for the hearing.

Being recognised for his defense, M. Çelik denied all the accusations leveled against him.

Çelik said in his defense that throughout his 25-year career he had been appointed as a member of the Council of State in 1997 after serving as an administrative judge, then appointed to the inspection board in 2004 and assigned as a member of the Council of State in 2011. He stated in his defense that he had all the required qualifications for the membership and had no restriction to be appointed.

Çelik also said “This trial is of that which has been created in this political climate. Which evidence has been submitted in the court for me as to being a member of a bloody-minded terror organisation? Now, I am a victim however this politic process also makes those victim tomorrow who have been conducting these trials. I strictly deny the allegation leveled against me as to being a member of a bloody-minded terror organisation. It doesn’t exist any concrete allegation delivered to me”.

Çelik also responded the accusation as to that the case filed by the candidate judge Gülay Tezcan who was removed from the office on the grounds that she missed the training classes for two days was dropped upon the order of the organisation by the plenary sessions of the chambers for administrative cases of the Council of State. Asserting that he had not acted in accordance with the order of anyone, Çelik said: “No need for anyone to give direction to me, If a recruit judge does not attend classes for two days and afterwards attempts to take a fake medical report , I also make the same decision today. Such a person behaves like this can not be a judge. Also today, I am of the same mind”.

Also speaking to confessor witness reports about him, Çelik defended that the confessor witnesses had tried to save themselves. He claimed: “Those people were made confessors being said they could not get out of the prison otherwise. I was also offered to do so”.

Rejecting that he had used ByLock app, Çelik said: “A senior judge of the state can not be a member of a terror organisation. I did not download ByLock app and also not use it. No content, no message, no information. So, I don’t ask for my release under such conditions”.

Following the break, the panel of judge announced their interlocutory decision. Accordingly, the court ruled the continuation of pre-trial detention for M. Çelik.

Dismissed judge, member of YARSAV and YARGICLARSEN, Tuncay Elarslan was indicted for terrorism on 21 February 2018

Judge Tuncay Elarslan, member of dissolved YARSAV and active YARGICLARSEN, was dismissed and detained after July 2016, released on condition that judicial measure.

He was indicted on 21 Feb 2018 for being member of terror organisation, joining famous anti-Erdogan “Gezi Park” demonstration in 2013, supporting YARSAV members in Judicial Council election. (1)

He previously stated briefly that, “I was targeted because of being opponent and leftist. Besides, I was indicted on defaming Erdogan just for my critisizm. Ruling party used July 15 as an oportunity to purge me over the pretext of terrorism. I will continue to fight against unfair implementations of ruling party”(2)

4560 judges and prosecutors have been dismissed and most of them were detained including some members of YARSAV and YARGICLARSEN since July 2016.

FORMER CHIEF PROSECUTOR SENTENCED TO 7 YEARS AND 6 MONTHS IN PRISON DESPITE HIS SERIOUS ILLNESS ON 27 FEB 2018

Dismissed former chief prosecutor Mehmet Arzık was sentenced to 7 years 6 months in jail by Istanbul 28th Assize Court for being member of armed terrorist organisation on 27 Feb 2018.

Mehmet Arzık was arrested on 16 July 2016. In the course of tenth month of his imprisonment in Silivri prison, he lost 17 kg. Despite the fact that he was suffering from ulcerative colitis, had bleeding, he was denied from receiving any treatment and his requests for release to have a colonoscopy were rejected with robot-like trite statements. Although it was known that if he did not receive urgent treatment his situation would worsen, Arzık was left to die in prison. Due to the intense pressure on social media, he was released on 9 June 2017 and placed in a hospital.

He will be put in prison again to serve remaining sentence if appeal courts uphold the conviction.
