International Associations of Judges (IAJ) introduced the book on its website as follows:

Hopes in exile

Dear readers,

I am one of the thousands of dismissed judges in Turkey. My 12-year-long career as a judge, like my wife’s and thousands of colleagues’,  ended in the following days of July 15 night that was dark and yet to be enlightened.

These days were indeed dark since the Turkish judiciary, we dedicated ourselves for years, did begrudge its own members the very basic human rights. Arrests, detentions, solitary confinement enforcements, and even deaths followed each other without any constitutional, legal, or conscious rights to be enjoyed. Swearing and insult was not considered as inhuman treatment in these dark days.

While I had traveled abroad for educational and touristic purposes before, this time, after a while, I decided to leave my country as a desperate refugee who was trying to protect himself and his family and keep them away from the persecution in our own land. We fled our home without knowing even where we headed off, or what was waiting for us during our journey. Leaving everything we had along with our memories behind, we fled from our country for which I was honored to be serving towards an unknown. Almost 2,5 years after the July 15 coup attempt, while trying to rebuild our lives from beginning, I want and hope to be a voice of thousands persecuted judges tens of whom are my closed friends and their families suffering from the unlawful and unconstitutional implementations of Erdogan Government. With knowing that cannot change a single thing under the current circumstances, I sincerely believe that staying silent and doing nothing is definitely not much heavier than the sense of responsibilities in my heart towards my friends, colleagues, and my country. It is so hard and unbearable that witnessing our state, founded by Atatürk and aimed at catching the level of secular, modern, and western civilizations turning into a dictatorship where the people are deprived of basic human rights gained through centuries and painful experiences of humanity. However, I would consider myself privileged and peaceful if I can make a small contribution to the studies over this era when all modern law theories and doctrines have been trashed.

In the following days, I would like to share with you what we have been through for the last 2,5 years as well as the stories of the victimized judges and their families in Turkey.

My only motivation and hope is that Turkey would be a constitutional-democratic, secular state based on rule of law and respecting the freedoms one day. I believe that we will get to be a respected member of the world.

Justice Şuayip Şen, member of Court of Cassation (Supreme Appeal Court) sentenced to 7 years 6 months in prison on 22 November 2018

Dismissed and arrested Justice Şuayip Şen, member of Court of Cassation, was sentenced to 7 years 6 months in prison over the pretext of terrorism charges on 22 November 2018.

Furthermore, court ruled for continuation of his detention.

This is the first conviction against dismissed members of Court of Cassation.

54 military judges and prosecutors sentenced between six years three months and eight years nine months. 26 October 2018

Following the last hearing of the trial held on 26 October 2018 before the Ankara 16th Heavy Penal Court, 26 military judges and prosecutors received several sentences in prison from six months three months to seven years six months. (1) The same court had also sentenced 28 military judges and prosecutors between six years three months and eight years nine months on 19 July 2018. (2)

In the indictment, the military judges and prosecutors were charged with carrying the same motivation and actions along with the military personal who had launched the coup attempt because the names of the accused military judges and prosecutors were allegedly found on “the Martial Court Assignment List” despite the fact that who prepared that list is still unclear. The chief judge of the court, Sabahattin Saridogan announced that while the military judges were requested to be sentenced for “attempting to abolish the constitutional order” and for “qualifed theft by deception by causing loss to public organs and institutions”, they found the defendants not guilty under the obtained evidence. However, the chief judge stated that the court found the defendants guilty for “being members of an armed terrorist organisation.”

Since the July 15-coup attempt, it has been a common practise of the Turkish courts that those who had been previously arrested and detained due to the accusations of participation in the coup and attempting to abolish the constitutional order have been sentenced for “being members of an armed terrorist organisation” even though no evidence showing their participation in the coup was found while they should have been acquitted from all charges.

The contradiction in the court’s decision is clear: The military judges and prosecutors who were indicted with being coupers and attempting the abolishing the constitutional order just because their names were allegedly found on the “Martial Court Assignment List”, were found not-guilty for attempting a coup due to the lack of evidence: However, the same list, who prepared that list is still undetermined, is accepted by the courts as a concrete evidence for “being a member of an armed terrorist organisation.”

Using the July 15-coup attempt as an instrument to take over both the civil and military judiciary, the Erdogan regime has removed the majority of the military judges and prosecutors. It is claimed that the number of the military judges decreased to 209 from 468 since 15 July 2016 while many others have been still under judicial or administrative investigation. (3)

Adil Öksüz’ü serbest bırakan hakim Köksal Çelik ve serbest bırakılmaya itirazı reddeden hakim Çetin Sönmez meslekten ihraç edildi. 1 Kasım 2018

Hakimler ve Savcılar Kurulu (HSK) 2’nci Dairesi, 15 Temmuz darbe teşebbüsünde rol aldığı iddiasıyla gözaltına alınan Adil Öksüz’ü serbest bıraktıkları gerekçesiyle hakimler Köksal Çelik ve Çetin Sönmez’i ihraç etti. (1)

Hâkim Köksal Çelik, Öksüz’ü, ‘yurtdışı yasağı’ kararı vererek adli kontrol şartıyla serbest bırakmış; savcılığın bu karara yaptığı itirazı değerlendiren Hâkim Çetin Sönmez de, tutuklamaya yönelik delil olmadığı gerekçesiyle itirazı reddetmişti.

Öksüz’ü serbest bırakan asıl hakimin Köksal Çelik olduğu, Çetin Sönmez’in ise sadece karara itirazı reddettiği halde, Çetin Sönmez’in 23 Mayıs 2017 tarihinden beri tutuklu olup 28 Ağustos 2018’de 8 yıl 9 ay hapis cezasına çarptırılmasına rağmen (2), Köksal Çelik hakkında halen adli soruşturma dahi açılmamış olması çifte standart olarak yorumlanıyor.

Ankara 16. Ağır Ceza Mahkemesinde 26 Ekim 2018 tarihinde yapılan duruşmada 26 askeri hakim ve savcıya 6 yıl 3 ay ile 7 yıl 6 ay arasında değişen hapis cezaları verildi. (1) Aynı mahkemede yapılan 19 Temmuz 2018 tarihli duruşmada da 28 askeri hakim ve savcı hakkında 6 yıl 3 ay ile 8 yıl 9 ay arasında değişen hapis cezaları verilmişti. (2)

İddianamede, sanık hakim ve savcıların kimin tarafından hazırlandığı hala belirlenemeyen Sıkıyönetim Mahkemeleri Görevlendirme Listesinde isimlerinin bulunması nedeniyle, darbe girişiminde bulunan askeri kanatla fikir ve eylem birliği içerisinde oldukları belirtilmişti. Mahkeme başkanı Sabahattin Sarıdoğan, iddianamede sanık hakim ve savcıların “anayasal düzeni ortadan kaldırmaya teşebbüs” ve “kamu kurum ve kuruluşlarının zararına dolandırıcılık” suçlamasından cezalandırılmasının talep edildiğini, ancak mevcut deliller eşliğinde bu suçlamalardan dolayı beraat kararı verildiğini ve buna karşılık “silahlı terör örgütüne üye olmak” suçunun mahkemece kabul edildiğini belirtti.

15 Temmuz darbe girişimi sonrasında, darbeye katıldığı ve böylelikle “anayasal düzeni ortadan kaldırmaya teşebbüs” ettiği suçlamasıyla tutuklanan kişilerin, darbeye iştiraklerine dair delil bulunmadığı anlaşıldığında tüm suçlamalar hakkında beraat kararı yerine soyut gerekçelerle “silahlı terör örgütüne üye olmak” suçundan mahkumiyet kararı verilmesi yaygın bir uygulama haline gelmiş durumda.

Darbeciler tarafından hazırlandığı iddia edilen Sıkıyönetim Mahkemeleri Görev listesinde adlarının bulunması sebebiyle darbeci olmakla ve Anayasal düzeni yıkmaya teşebbüs etmekle suçlanan askeri hakim ve savcılar darbeye ilişkin herhangi bir delil bulunmaması nedeniyle beraat ederken ayni liste hakim ve savcıların silahlı terör örgütü üyeliği için yeterli kabul edilmektedir.

15 Temmuz darbe girişimini hem askeri hem sivil yargıyı mutlak kontrolü almak için bahane olarak kullanan iktidar, bugüne kadar askeri yargı mensuplarının büyük çoğunluğunu tasfiye etti. 15 Temmuz 2016’da 468 olan askeri hakim sayısı 209’a kadar düştü. Birçok askeri yargı mensubu hakkında incelemenin devam ettiği belirtiliyor. (3)

Savcı Ferhat Sarıkaya meslekten ikinci kez ihracının ardından 8 Kasım 2018 günü tutuklandı

Cumhuriyet savcısı Ferhat Sarıkaya Hakimler Savcılar Kurulu (HSK) tarafından 1 Kasım 2018 tarihinde meslekten ikinci kez ihraç edildi.

2006 yılında Şemdinli’de bir kitabevinin bombalanması olayına karıştığı iddia edilen askerlere sahip çıkması üzerine dönemin Kara Kuvvetleri Komutanı Orgeneral Yaşar Büyükanıt hakkında bazı iddialara yer vermesi ve bu iddialarla ilgili Genelkurmay Askeri Savcılığı’ndan soruşturma yapılmasını istemesi, Ferhat Sarıkaya’yı kamuoyunun gündemine taşımıştı. (1) Sarıkaya, bu isteği nedeniyle HSK tarafından Nisan 2006’da meslekten ihraç edilmişti. (2)

2010 yılı Anayasa değişiklikleriyle HSYK üye seçim sisteminin değiştirilmesinin ardından, yeniden seçilen HSYK, 2011 yılında Sarıkaya’yı mesleğe iade etmişti.

2017 yılında yapısı tekrar değiştirilen ve  iktidar partisine tamamen bağımlı hale getirilen HSK, Ferhat Sarıkaya’yı önce açığa aldı ve nihayet 1 Kasım 2018 tarihinde ikinci kez meslekten ihraç etti. Sarıkaya açığa alınmasının ardından, bazı yargı mensuplarının Şemdinli soruşturması sırasında kendisini yönlendirdiğini iddia etmişti.
İhraç sonrası hakkında “terör örgütü üyesi” olduğu iddiasıyla soruşturma açılan Sarıkaya, 8 Kasım 2018 tarihinde tutuklandı. (3)
