Akay was accused of the using ByLock e-message application which accepted as the means of communication by Gulenists. In addition to 7,5 years imprisonment, on 15 June 2017, first instance court has placed an international travel ban on Akay, which meant that he could not resume his work with the UNMICT (Ruanda genocide case). Akay lodged an individual application to Constitutional Court and resort his diplomatic immunity due to the fact that he was a UN judge. However, Constitutional Court dismissed his application reasoning that he had no diplomatic immunity in Turkey since he is a Turkish citizen and there was reasonable ground (ByLock) for his arrest.
