​COURT SENTENCED WOMAN JUDGE SEMA A. AND DECIDED TO CONTINUATION OF HER ARREST

 

Dismissed woman judge Sema Alkan was sentenced to 8 years and 9 months in jail by Gaziantep 10th Assize Court for being member of armed terror organisation on 25 Jan 2018

She was accused of using ByLock secure mobile application which was available on Google and Apple Stores and staying in the same home with some friends who were allegedly Gulenists during universty and judgeship examination period.

She denied accusation, asked her acquittal and release by emphasizing ByLock evidence is illegal/incredible and others were inoperative.

After convicting, court ruled to continuation of her arrest.

DISMISSED PROSECUTOR M. TURGAY B. SENTENCED TO 9 YEARS IN PRISON

Dismissed prosecutor Muhammet Turgay Başkan was sentenced to 9 years in jail by Gaziantep 10th Assize Court for being member of armed terror organisation.

He was accused of using ByLock secure mobile application which was publicly available on Google and Apple Stores in the past and keeping some Gulen books in his car.

He denied accusation, asked his acquittal and his release by emphasizing he has been under arrest for a long time.

After convicting, court ruled to continuation of his arrest. (1)

Muhammed Turgay Başkan had been acting as a judge for 10 years before he was degraded as a prosecutor by pro-Erdogan Judicial Council on 7th June 2016. (2)

When he was presiding judge at Kırşehir 2nd Criminal Court, he acquitted defendants who joined demonstration march in Kırşehir to support famous Gezi protests held in Istanbul against Erdogan Government in 2013. He ruled that demonstrations were peaceful and it is fundamental rights of citizens by referring ECtHR’s Barankeviche v. Russia judgment. (3)

He was blacklisted as opponent after his aforesaid decision and lost his judge post. After coup attemp, he was arrested over the terrorism charges based on lists prepared years ago.

Project manager of awarded e-justice (UYAP) system of Turkey, justice at Court of Cassation Ali Kaya has been under isolation in prison since July 2016

Justice of Court of Cassation, former member of Supreme Board of Election, founder and project manager of internationally awarded e-Justice System of Turkey named UYAP, Ali Kaya has been under solitary confinement since July 2016.

Court ruled continuation of his arrest at the first hearing on 23 Jan 2018. Next hearing is on 3 May 2018.

​DISMISSED FOUR JUDGES AND PROSECUTORS ARE SENTENCED UP TO 7 YEARS 5 MONTHS IN PRISON

4 judges and prosecutors were sentenced to long term in jail by Samsun 2nd Assize Court for allegedly being members of armed terrorist organisation due to ByLock mobile application usage in the past.

Arrested judges and prosecutors’ trials were seperately held in and 3 of whom joined to hearings via video conferencing from prisons where they are kept in since July 2016.

They demanded their acquittal and release by denying all accusations.

Court convicted and sentenced Abdullah Dertli, Ünal Ulus, Serkan Taş to 7 years 5 months 3 days; Harun Orman to 6 years 9 months in jail.

Court decided to continuation of arrest for Abdullah Dertli, Ünal Ulus, Serkan Taş while releasing Harun Orman.

PROSECUTOR OKTAY B. SENTENCED TO 6 YEARS 9 MONTHS IN PRISON

Dismissed prosecutor Oktay Bahadır was sentenced 6 years 9 months in jail by Samsun 2nd Assize Court for being member of armed terror organisation due to ByLock.

He joined hearing via video conferencing from Tokat prison where he has been kept in.

He was accused of using ByLock secure mobile application which was available on Google and Apple Stores.

He denied accusation and emphasized lots of mistakes/contradiction about ByLock evidence, asked his acquittal and his release by reiterating he has been under arrest for 18 months.

After convicting, court released him by considering his long detention period.

​JUDGE SINAN K. SENTENCED TO 7 YEARS 6 MONTHS IN JAIL

Dismissed judge Sinan Kart was sentenced 7 years 6 months in jail by Antalya 9th Assize Court for being member of armed terror organisation due to ByLock.

He joined hearing via video conferencing from prison where he has been under arrest.

He was accused of using ByLock mobile application for 83 days in the past.

He denied accused and defended some other applications may direct the users to ByLock servers and share the same IP with ByLock.

He asked his release and said he believes he will be reinstated as a judge in the future but court convicted him.

Dismissed judge İdris Eğilmez was sentenced to 7 years and 6 months in jail by Antalya 10th Assize Court for being member of armed terrorist organisation due to ByLock application although he defended he did not use it and there is only [intelligence] assessment.

He denied all accusations and asked his release and acquittal.

​DISMISSED JUDGE & CHIEF PROSECUTOR COUPLE DETAINED FOLLOWING POLICE RAID

Dismissed Judge Ayse D. and her husband chief prosecutor Hakan D. who have been at large since July 15, 2016, were detained in Antalya following police raid on 19 Jan 2018.

They have been wanted by police with arrest warrant since coup attempt for allegedly being member of terrorist organisation.

They are accused of using secure mobile ByLock application in 2014 which was publicly available on Google and Apple Stores.

They have not been using mobile phone and have been changing their location frequently not to be arrested so far.

After they were referred to be arrested, Antalya 1th criminal judge of peace ruled to arrest order for prosecutor Hakan D. while releasing judge Ayşe D. with judicial control on 26 Jan 2018.

Judge Yılmaz Erdem was sentenced to 7 years 6 months imprisonment for allegedly being member of armed terrorist organisation on 19 January 2018.

Judge Erdem joined to hearing via video conferencing system from prison where he has been under arrest since July 2016. Adana 2nd Assize Court convicted and sentenced him over ByLock application usage which was publicly available on Google and Apple store although he denied all accusations and asked his acquittal.
